Daniel J. Finerty joined the firm in 2001 and concentrates his practice on labor and employment litigation. Here are some examples of cases that Daniel has handled:

  • Daniel has successfully prosecuted numerous actions on behalf of companies seeking enforcement of restrictive covenants, including non-competition, non-solicitation and confidentiality agreements in Wisconsin , Ohio , South Carolina and elsewhere.

  • Daniel has effectively represented numerous companies and public entities in defending discrimination, harassment and retaliation cases filed by the Equal Employment Opportunity Commission and private plaintiffs in federal court and in front of the EEOC and the Wisconsin Department of Workforce Development.

  • Daniel has filed and assisted in the prosecution of labor litigation cases including a company’s motion seeking to vacate a labor arbitration award and an employer’s action seeking a Boys Markets labor injunction to enjoin a work stoppage.

  • Daniel has represented various healthcare and elder care facilities in retaliation cases arising under the Wisconsin Health Care Worker Protection Act.

Daniel regularly advises clients regarding theft and fraud unknowingly committed by employees and works with clients to develop and implement effective drug and alcohol testing programs and procedures. Daniel also drafts severance agreements, employment contracts, inspection policies, bonus programs and conducts handbook reviews.

Daniel’s clients include companies in industries such as private construction, manufacturing, hospitality, health care and elder care as well as representation of public entities. He is admitted to practice in all Wisconsin state courts, the U.S. District Court for the Eastern and Western Districts of Wisconsin , and the U.S. Court of Appeals for the Seventh Circuit. He is a member of the State Bar of Wisconsin Labor And Employment Law and Business Law Sections, the ABA Labor and Employment Law Section and the Milwaukee Bar Association. He as a 1998 graduate of Marquette University Law School and a 1994 University of Wisconsin Madison graduate with a double major in political science and Spanish. 

Daniel was included among Wisconsin ’s Rising Stars in Milwaukee Magazine’s Super Lawyers yearly supplement in 2006 and 2007 and is a volunteer for the Milwaukee 7’s CEO Call program. Daniel is a regular speaker on labor and employment-related topics for several healthcare and other trade associations and provides on-site training to clients.
