Krukowski & Costello, S.C. represents employers in a variety of safety and health areas. The issues of safety and health have become increasingly regulated and the cost of compliance or noncompliance have dramatically increased in recent years. The firm represents employers during inspections conducted by OSHA and in the litigation of cases before the Occupational Safety and Health Review Commission. Krukowski & Costello has been involved in several major ergonomic cases in the warehousing and meat packing industries. Its recent experience in defending such a case resulted in the citation being dropped. In another case, OSHA substantially reduced the proposed fines as well as eliminated over half of the citations that were originally issued. As penalties have been dramatically increased for repeat OSHA violations, we have represented many employers in reviewing and contesting citations issued by OSHA.
In order to avoid the cost of noncompliance, the firm is actively engaged in the drafting, review and implementation of safety and health policies. Examples include bloodborne disease, lockout/tagout, recordkeeping, inspection, ergonomics, hazard communication and drug testing policies. Krukowski & Costello drafts and implements worker's compensation cost reduction programs. When claims do occur, the firm represents both insurance companies as well as employers in defense of primary worker's compensation claims as well as secondary claims involving unreasonable refusal to re-hire and violation(s) of a safety standard.
The firm's preventative approach in the field of safety and health reduces or eliminates the cost of noncompliance and, at the same time, yields an immediate payback for the employer in the form of safe work practices and the reduction of worker's compensation costs. If necessary, Krukowski & Costello is prepared to litigate on behalf of employers when OSHA, or any other government agency, oversteps its bounds.
