Public demand for health care reform will continue to significantly impact the delivery of health care services. At the same time, health care employers must comply with the increased regulations created by the Civil Rights Act of 1991, the ADA and OSHA standards. For the labor intensive health care industry, the goal of sustaining growth and productivity within the legal framework of the employment relationship will become even more complicated.

To meet these challenges, we help employers engage in a strategic planning process to assess needs, set goals and prepare a plan of action. Our health care team regularly evaluates the possible effects of regulatory changes on the industry and on individual clients as well. To help employers take a proactive approach to labor relations and human resources, we publish the Employment Law Manual for Wisconsin Employers on all pertinent labor and employment law matters. Employers appreciate that we help them keep costs down by maintaining an up-to-date awareness on issues that may affect their operations.

We believe in prevention and have successfully trained executives and managers to develop procedures they need to comply with the law. Our health care team has worked with employers to draft, review and implement procedures on the ADA, sexual harassment, worker's compensation, wage and hour, OSHA regulations and ergonomic guidelines.

We anticipate an increase in the level of union organizing in health care facilities. Operating in a union-free environment requires a commitment to both long- and short-term needs of the workforce and the patients served by the facility. We conduct vulnerability studies and provide legal counseling on all facets of the National Labor Relations Act and its permitteed and prohibited conduct. Krukowski & Costello also represents clients in all phases of collective bargaining and has an excellent record of negotiating agreements—many with significant labor cost savings—without work interruption.
